SHAKTI SHANTI AFFILIATE TERMS & CONDITIONS
Thank you for considering the Shakti Shanti™ Affiliate Program. Our affiliates are very important to us. This agreement is designed with all parties in mind, protecting you, Shakti Shanti™ and our customers. Please read thoroughly. Affiliate Agreement
This agreement describes the terms and conditions for participation in the Shakti Shanti™ Affiliate Program. In this agreement, the term “Affiliate” refers to you (the applicant). In this agreement, “Shakti Shanti™” refers to Shakti Shanti Universal Wear c.c. trading as Shakti Shanti Yoga Wear, with whom you are entering this agreement. By joining the Shakti Shanti™ affiliate program you are confirming that you have read the agreement and agree to the terms and conditions.
Commissions
For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate Links. Properly coded links are the sole responsibility of the affiliate. The Affiliates generate their unique links on the Affiliate Dashboard. Commissions can be viewed on the Affiliate Dashboard. The Affiliate will be receiving 10% commission on products purchased. When the Affiliate reaches R100 000 in generated sales they will start receiving 15% commission. Once the Affiliate reaches R200 000 in generated sales they will then start receiving 20% commission.
The Affiliate will continue to accumulate commissions for each paid transaction by the customer for as long as the customer remains a paying customer and as long as the customer uses their unique Affiliate Link. The customer will be getting 10% off full priced items when they use the Affiliate’s link.
Payment
An Affiliate can request a payment when their balance reaches a minimum balance of R500. Payments can be requested every 30 days. Payment processing takes 30 days from the last successful purchase date (due to potential refunds, see below). Payments will generally be paid out via Standard Bank South Africa. Refunds
In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance. This is the main reason for making payment to affiliates in 30 days, in order to give clients the time to return garments if they are not happy with their purchase. We do feel that buying on line (especially for first timer customers) can feel risky and we want all our clients to feel secure in their purchases with us.
Usage and Obligations
Affiliates are permitted to use the Shakti Shanti™ brand and marketing resources available. Logos and other assets cannot be modified. The Affiliate does not gain any trademark, copyright or any other rights to these materials. The Affiliate will never imply that they are acting on behalf of Shakti Shanti™. The Affiliate will never bid for advertisements that compete with Shakti Shanti™. The Affiliate will never represent themselves, Shakti Shanti™ or their relationship with Shakti Shanti™ in a false or misleading way and will uphold the ethics and values that the brand represents. The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing Shakti Shanti™. All Affiliates will be signed up to our newsletters upon registering the Affiliate Program.
Social Media
When the Affiliate registers they are encouraged to share their unique Affiliate link on all social media platforms such as Instagram, Facebook, TikTok, Pinterest, Twitter and YouTube. Whenever the Affiliate uses their unique link Shakti Shanti™ ask the Affiliate to tag Shakti Shanti™ on the corresponding platform. Shakti Shanti™ ask all Affiliates to follow all related Shakti Shanti™ social media accounts. While the Affiliate is an active Affiliate for the Shakti Shanti™ brand any content that applies to Shakti Shanti™ can be used across all Shakti Shanti™ platforms. When Shakti Shanti™ does use the Affiliates content for the brand they will be tagged and the Affiliates unique link will be shared. The more content the Affiliate give Shakti Shanti™ to share the more exposure the specific Affiliates link will receive. The Affiliate is encouraged to share any extra photos or videos that are related to Shakti Shanti™. The Affiliate can be asked by Shakti Shanti™ to create content for any social media platform but it is the Affiliates right to decline the offer.
Taking out garments on Apro
When an Affiliate takes a Shakti Shanti™ garment on Apro it means they are loaning the item. Shakti Shanti™ is still the owner of the garments that are sent on Apro. Affiliates that choose to take garments out on Apro are responsible for the care on the garment. If the garment is damaged or the tags are removed from an Apro garment the Affiliate will have to pay for the Apro garment. 20 garments are allowed out on Apro at a time to Affiliates in South Africa. An Affiliate can only take 4 garments on Apro at a time. The Affilaite can keep the garments on Apro for 2 weeks before needing to give it back to Shakti Shanti™ in the same condition the Affilaite received it in. The Affiliate will be receiving these garments in individual sealed bags, when the Affiliate gives back the garments they will need to be placed back into the same sealed bags. If the Affiliate wants more time with a garment for take further content with the garments they need to contact creative@ssyw.com to get permission to keep the garment longer.
Term and Termination
Either party has the right to terminate the agreement immediately without prior notice.
If the Affiliate terminates the agreement, no further commissions from Shakti Shanti™ will be paid for any future customer transactions and any balance owing will be paid within 30 days.
If Shakti Shanti™ chooses to terminate the agreement, any balance will be paid to the affiliate within 30 days of termination.
Governing Law
This Agreement shall be governed, construed, and enforced in accordance with the laws of South Africa, without regard to its conflict of laws rules.
Arbitration
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in Port Elizabeth, Eastern Cape, South Africa. An award of arbitration may be confirmed in a court of competent jurisdiction.
Modification
We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures and Affiliate Program rules.
This program is open Worldwide. But Shakti Shanti™ has the right to decline the application to become an Affiliate.
